Welcome to Orbia World. These Terms of Service (“Terms”) govern your use of our website located at https://orbia.world (the “Site”). Please read them carefully.
By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site.
In these Terms, “we”, “us” and “our” refer to Rautenbach Ltd, trading as Orbia World, and “you” refers to any visitor or user of the Site.
Orbia World is currently in development. At this stage, the Site is used to:
Share information about the Orbia World concept and the future student log app
Allow visitors to sign up for:
a newsletter (email only), and/or
the Founding Families list (first name, last name, and email)
Provide a way for you to contact us with questions or feedback
Share updates about future features, including optional messaging channels (such as WhatsApp)
The Orbia World student log app is not yet publicly available. When it is launched, we may introduce additional or updated terms to cover the use of that app and any related services.
You may use the Site only if:
You are at least 18 years old, or
You are using the Site with the consent and supervision of a parent or legal guardian.
By using the Site, you confirm that you have the legal capacity to agree to these Terms.
When using the Site, you agree that you will:
Provide accurate and honest information when you sign up for updates or contact us
Use the Site for lawful purposes only
Respect the rights of others and not attempt to gain unauthorised access to any part of the Site, our systems, or data
You agree that you will not:
Use the Site in any way that violates applicable laws or regulations
Attempt to disrupt or interfere with the Site, its security, or any related networks
Use automated tools (such as bots or scrapers) to access the Site in a way that imposes an unreasonable load on our infrastructure
If you subscribe to our newsletter or join the Founding Families list, you agree that we may send you emails related to:
Orbia World updates, progress, and launch news
Early access invitations and beta opportunities
Requests for feedback, research participation, or user interviews
Administrative or legal notices about the Site
You can unsubscribe from marketing emails at any time using the unsubscribe link in our emails. You can also contact us to be removed by emailing [email protected].
We use self-hosted Mautic to manage our mailing lists and email communications.
Orbia World may offer the option to communicate via WhatsApp using the Meta WhatsApp Business API.
If you choose to message us on WhatsApp (or provide your number and request WhatsApp contact), you understand and agree that:
We may receive, store, and process messages and any attachments you choose to send (such as photos or voice notes), in order to provide support and (in the future) help organise learning logs.
WhatsApp is operated by Meta/WhatsApp, and your use of WhatsApp is also subject to WhatsApp/Meta’s own terms and policies.
Standard carrier/data charges may apply from your mobile provider.
WhatsApp is not an emergency service. Do not use it for urgent or emergency matters.
You can stop WhatsApp messages at any time by following the opt-out instructions we provide (for example, replying “STOP”) or by emailing [email protected].
Unless stated otherwise, all content on the Site is owned by us or used with permission. This includes:
Text and website content
Logos, trademarks and branding
Images, graphics and design
Layout and overall look and feel of the Site
You may view the Site and print or download content for your personal, non-commercial use only.
You may not, without our prior written consent:
Copy, reproduce, distribute, modify, or create derivative works based on the Site or its content
Use any of our trademarks, logos or branding
Use our content for commercial purposes
The information on the Site is provided for general informational purposes only. It is not:
Legal advice
Educational or professional advice
Official guidance from the New Zealand Ministry of Education or any government agency
We aim to design Orbia World to support families with home education reporting. Still, we do not represent or act on behalf of the Ministry of Education, and we cannot guarantee that any future reports or tools will meet every requirement for every situation.
You remain responsible for understanding and meeting any legal or regulatory requirements that apply to your family.
Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use and protect personal information (including newsletter/founding families signups, contact form submissions, analytics, and WhatsApp messaging where used).
The Site is provided on an “as is” and “as available” basis.
We may, at any time and without notice:
Change or update the content of the Site
Temporarily or permanently stop operating some or all of the Site
Restrict access to some parts of the Site
We are not liable to you or any third party for any modification, suspension or discontinuation of the Site.
The Site may contain links to third-party websites or services. These links are provided for convenience only.
We do not control and are not responsible for:
The content of those websites
Their privacy practices
Any products or services offered through them
Your use of third-party websites is at your own risk and subject to their own terms and policies.
To the fullest extent permitted by law, we disclaim all warranties, express or implied, in connection with the Site and your use of it. This includes, but is not limited to, implied warranties of:
Merchantability
Fitness for a particular purpose
Non-infringement
We do not guarantee that:
The Site will always be available, secure and error-free
The information on the Site will always be complete, accurate and up to date
Any defects or errors will be corrected
To the fullest extent permitted by law, we will not be liable for any:
Indirect, incidental, special, consequential or punitive damages, or
Loss of profits, revenue, data, goodwill or other intangible losses
arising out of or in connection with your use of (or inability to use) the Site.
If we are found to be liable to you for any reason, our total liability to you for all claims arising from or relating to the Site will not exceed NZD $100 or the minimum amount required by law, whichever is greater.
Nothing in these Terms limits any rights you may have under New Zealand consumer law that cannot be legally excluded.
You agree to indemnify and hold harmless Rautenbach Ltd (trading as Orbia World), its directors, employees and agents from and against any claims, losses, damages, liabilities, costs and expenses (including reasonable legal fees) arising out of or related to:
Your use of the Site
Your breach of these Terms
Your violation of any law or the rights of any third party
We may suspend or terminate your access to the Site at any time, without notice, if we reasonably believe that you have:
Violated these Terms, or
Used the Site in a way that could cause harm to us, other users or third parties
Upon termination, your right to use the Site will immediately cease. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitations of liability and governing law) will continue to apply.
We may update these Terms from time to time. When we do, we will change the “Last updated” date at the top of this page.
If the changes are significant, we will try to provide additional notice (for example, by posting a notice on the Site or sending an email to subscribers).
By continuing to use the Site after changes are published, you agree to be bound by the updated Terms.
These Terms and your use of the Site are governed by the laws of New Zealand, without regard to conflicts of law principles.
You agree that any disputes arising out of or relating to these Terms or the Site will be subject to the non-exclusive jurisdiction of the courts of New Zealand.
